Appeal
Kingston upon Thames
March 2022
WEA Planning won an appeal against RB Kingston upon Thames to permit the construction of a contemporary two-bedroom house on Arundel Road in Norbiton. The decision allows the comprehensive redevelopment of this large plot and the construction of two detached modern houses following the demolition of an existing derelict bungalow.
The applicant contacted WEA Planning after the refusal of planning permission for the construction of this modern detached house designed by Jameson-Surveyors. WEA Planning advised the applicant that the most pragmatic option was to appeal the refused application to submit the case to the Planning Inspectorate for independent assessment.
WEA prepared and submitted the appeal on behalf of the client. We thoroughly researched precedents and put together a strong case to demonstrate that the Council’s reasons for refusal were unfounded. We also demonstrated the careful design and orientation of the building by the architect did not result in any harmful impact for the neighbouring property.
As part of the strategy, we advised the client to submit a second proposal for a smaller 1-bedroom house again with a contemporary design. This reduced proposal was quickly approved by the planning officer and highlighted the Council’s analysis was unjustified. This approved reduced scheme created a strong fallback option for the appeal decision.
The Planning Inspector agreed with all WEA Planning’s arguments and granted permission for the construction of this attractive two-bedroom house, maximising the site and creating a home suitable for a young family.
